We are committed to providing you with a safe place to upload, share, and order photo products. The photos that you upload on our site are generally protected by a password linked to your account, and not accessible to anybody else.

We collect your information in a few different ways: when you register on the Site and provide your personal information, or when you use any of our Services on our Site. Personal information can include information such as: name, address, email address, phone number, date of birth, and any other information that may personally identify you.

If you place an order through our Site you will have to provide Personal Information such as your name, address, and billing information so that we can process your order. We may also ask you for information when you report a problem or issue you are having with our Site. If you communicate with us via email, we may keep a record of that correspondence. 

When you are asked for personal information on our Site, you are sharing that information only with us and our affiliates.

5. Third-party services

We hire third party photo labs to fulfill Site orders and ship them on our behalf. We only provide those companies with the information they need to deliver the service or product.

We use third party services and social plugins to improve the customer experience. 

Our website contains buttons from Facebook and Instagram. We would like to expressly state that we have no influence over the amount of data that these companies collect using the plugins and cookies.

Please consult the relevant company directly to find out more information about the purpose and extent of data collection as well as your individual rights and options to protect your privacy.

CherryPix utilises the following third-party services:

The headquarters of a third party may be located in a third country, i.e. in a country in which GDPR has no direct legal effects. 

Google, Facebook and Instagram comply with the Privacy Shield Agreement (EU-US Privacy Shield). this means that the requirements of the Privacy Shield agreement are identical to the level of data protection within the European Union. We provide links to the relevant privacy policies here. 

• Google Analytics

We use Google Analytics for analysing of and reporting on customer behaviour on our Site. Google Analytics is a web analysis service provided by Google. Google Analytics uses so-called “cookies”. These are text files, which are saved on our computer and allow for an analysis of your use of our Site. The information collected includes your operating system, browser, IP address and referrer URL. The information generated by the cookies about your use of the Site may be transferred to a Google server in the USA and stored there.

• Facebook and Instagram

CherryPix has integrated social plugins from Facebook and Instagram on our Site. The plugins are shown as a logo. If you click on one of these buttons/logos, the respective service provider will receive the information that you have accessed on our Site. You do not need a user account with the respective service provider; you also don’t need to be logged in if you have a user account. If, however, you have a user account and you are logged in, this information will be directly assigned to your account. 

CherryPix has no influence on for what purpose or for how long the service providers and social networks collect personal data.

CherryPix also gives you the opportunity of registering to our Services with Facebook Connect. There is no need for an additional registration, simply use your Facebook login details for registration.

You will be redirected to Facebook where you can log in using your login details. Your Facebook profile will be linked with our services so that you don’t need to re-enter all of your data. We receive various information from Facebook Inc. as a result of this link, depending on your privacy settings on Facebook.

This information always includes the publicly available profile information, such as your name, age, country, gender, profile picture, friends list and the information that you share with your friends list. We only save your name, email address and, if provided, your telephone number. This information is required to conclude the contract so we can identify you.

• Newsletters

The personal data we collect for sign-ups to our newsletter, we only use for our own marketing purposes in the form of our email newsletter. 

For sending newsletters, we use the service provider Mailchimp (The Rocket Science Group, LLC, 675 Ponce de Leon, Avenue NE, Atlanta, GA 30308, USA, http://www.mailchimp.com), and we provide them with your email address for the purpose of creating and sending the newsletter.

After you registered by entering your email address, you will receive a confirmation email to the address that you provided. This email contains a confirmation link. If you wish to receive our newsletter, click on the link to complete registration for our newsletter.

By clicking on the confirmation link, you are consenting to receive our newsletter. Only then will your email address be saved by the list provider until you unsubscribe from the newsletter or are deleted by CherryPix.

You can unsubscribe from the list at any time by clicking on the unsubscribe link, provided in the newsletter.

• Google Tag Manager

Our website uses Google Tag Manager. This service from Google Inc. allows website tags to be managed using an interface. Google tag manager only implements tags. This means no cookies are used, and no personal data is collected. Google Tag Manager can manage various tracking tolls and triggers the appropriate tags, which then collect the necessary data. All of the tracking tools used on our Site are mentioned in this Privacy Policy. 

• Google AdWords conversion tracking

This Site uses the online advertising program Google Adwords and the conversion tracking provided within the framework of Google Adwords. The conversion tracking cookie is saved when a user clicks on the Google ad. Cookies are small text files that are stored on your computer.  These cookies expire after 30 days and cannot be used for personal identification. If the user visits certain pages and the cookies do not expire, both we and Google can see that the user has clicked on the advertisement and be redirected to the page. The information collected using the conversion cookie serves to provide statistics about the conversions. These statistics can show e.g. how many users clicked on the ad and were forwarded to the Site with a conversion tracking tag. These statistics do not show any information that can be used to identify the user in person. If you do not wish to participate in tracking, you can revoke this by simply deactivating the Google conversion tracking cookie using the user settings on your internet browser. 

• Payment provider

To be able to receive your payments for your orders, we use the payment provider PayTabs. Your personal data such as name, address, and payment information such as bank and/or credit card information is shared with PayTabs.
